Terms of Service

1.1 Service Description

Blooperized is a multiplayer polygon-based image puzzle game operated by ARALU SINGLE MEMBER P.C. (doing business as "ARALU"), a company registered in Greece. The service allows users to create, share, and play puzzle challenges with friends.

1.2 Agreement to Terms

By accessing or using Blooperized (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

1.3 Age Requirement

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 13, you may not use the Service under any circumstances.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1.4 Additional Policies

These Terms incorporate by reference our Privacy Policy, which describes how we collect, use, and protect your personal information.

2.1 Account Creation

To use certain features of the Service, you must create an account using social authentication (e.g., Google, Apple, or other supported providers). We do not offer username/password registration.

2.2 One Account Per User

Each user is permitted one account only. Creating multiple accounts is a violation of these Terms and may result in termination of all associated accounts.

2.3 Account Security

You are responsible for:

• Maintaining the security of your social authentication credentials
• All activities that occur under your account
• Notifying us immediately if you become aware of any unauthorized use of your account

2.4 Account Information

By using social authentication, you authorize us to access certain information from your authentication provider (such as your email address and display name) as described in our Privacy Policy.

3.1 Ownership

You retain full ownership of all content you upload, create, or share through the Service ("User Content"), including images, puzzles, and other materials. ARALU does not claim any ownership rights to your User Content.

3.2 License Grant

By uploading User Content to the Service, you grant ARALU a limited, non-exclusive, royalty-free license to:

• Store and display your User Content to authorized viewers
• Process your User Content as necessary to operate the Service (e.g., creating puzzle segments)
• Create blurred or anonymized versions of your content for display purposes

This license is strictly limited to operating the Service. ARALU has no rights to use your content for marketing, promotion, advertising, or any purpose outside of providing the Service.

3.3 Content Visibility

Your User Content is only visible to:

• Players within your challenge chain (friends and friends of friends)
• Players who have played a puzzle you created

Your content is not publicly visible or searchable.

3.4 User Responsibility

You are solely responsible for:

• Your User Content and the consequences of uploading or sharing it
• Ensuring you have all necessary rights to upload content
• Ensuring your content complies with all applicable laws in your jurisdiction
• When sharing content with others, considering their local laws and regulations

3.5 Content Rating (Future Feature)

We plan to implement a content rating system in the future to help categorize content appropriateness. Details will be provided when this feature is available.

4.1 Prohibited Content

You may not upload, share, or transmit any content that:

• Infringes intellectual property: Content that violates copyright, trademark, or other intellectual property rights of others, unless you have the necessary rights or permissions
• Is illegal: Content that violates any applicable local, national, or international law
• Is pornographic or sexually explicit: Content depicting nudity, sexual acts, or sexually explicit material
• Promotes violence or hate: Content that promotes violence against individuals or groups, or constitutes hate speech
• Is harmful to minors: Content that exploits or endangers minors in any way

4.2 Prohibited Conduct

You agree not to:

• Create or maintain multiple accounts
• Use the Service for any illegal purpose
• Attempt to interfere with, compromise, or disrupt the Service
• Access or attempt to access accounts or data belonging to other users
• Use automated means (bots, scrapers, etc.) to access the Service without our permission
• Circumvent any access restrictions or security measures
• Harass, abuse, or threaten other users

5.1 Reporting

Users may report content they believe violates these Terms. We employ both automated detection systems and manual review processes.

5.2 Review Process

When content is reported or flagged:

1. Our automated systems perform an initial assessment
2. Manual review is conducted when necessary
3. Decisions are made based on these Terms

5.3 Content Removal

If we determine that content violates these Terms:

• The content will be removed from the Service
• The content creator will be notified of the removal
• Depending on the severity, additional actions may be taken (see Section 8)

5.4 Appeal Process

If you believe your content was removed in error, you may appeal by contacting us at [email protected]. Appeals are reviewed informally but in good faith. Include:

• Your account information
• Description of the removed content
• Reason you believe the removal was in error

We will respond to appeals within a reasonable timeframe, typically within 30 days.

6.1 ARALU Intellectual Property

The Service, including its design, features, code, graphics, and branding (excluding User Content), is owned by ARALU and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our express written permission.

6.2 User Intellectual Property

As stated in Section 3.1, you retain full ownership of your User Content. Nothing in these Terms transfers your intellectual property rights to ARALU beyond the limited license granted in Section 3.2.

6.3 Copyright Infringement Claims

If you believe that content on the Service infringes your copyright, please contact us at [email protected] with:

• Identification of the copyrighted work
• Identification of the allegedly infringing content and its location
• Your contact information
• A statement that you have a good faith belief the use is unauthorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

We will review and respond to valid notices in accordance with applicable law, including the EU Digital Services Act and relevant Greek law.

7.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Uptime Guarantee

We do not guarantee that the Service will be available at all times or without interruption. We may modify, suspend, or discontinue the Service at any time without notice.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARALU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any User Content uploaded to or transmitted through the Service

7.4 User Content Disclaimer

We do not endorse, verify, or guarantee any User Content. Users are solely responsible for their content and interactions. We are not liable for any User Content or for any actions taken based on User Content.

8.1 User-Initiated Termination

You may delete your account at any time through the Service settings or by contacting us at [email protected]. For details on what happens to your data upon deletion, see our Privacy Policy or contact us via the Support page.

8.2 Account Anonymization

When you delete your account:

• Your account is anonymized (personal data is removed or anonymized)
• Puzzles you created remain in a blurred state, accessible only to players who have previously played them
• Your username and identifiable information are removed from your content

8.3 Platform-Initiated Termination

We may suspend or terminate your account if you violate these Terms. Our actions are based solely on Terms violations, not arbitrary decisions.

• Warnings: Minor or first-time violations may result in a warning
• Suspension: Repeated violations may result in temporary suspension
• Termination: Severe violations (such as uploading illegal content, pornography, or repeated infringement) may result in immediate and permanent termination

8.4 Effect of Termination

Upon termination:

• Your right to access the Service will immediately cease
• We may delete or anonymize your account data
• Provisions of these Terms that by their nature should survive will survive termination

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law provisions.

9.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Greece.

9.3 European Union Rights

If you are a consumer residing in the European Union, you may have additional rights under EU consumer protection laws. Nothing in these Terms limits any rights that cannot be limited under applicable law.

10.1 Modifications

We may modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this document
• Notify users through the Service or via email for significant changes

10.2 Acceptance of Changes

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

11.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ARALU regarding the Service.

11.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
